Agreement

These terms are between you and Inertia Digital Marketing, LLC, a Florida limited liability company doing business as The Window Upgrader (“we”, “us”). By using www.thewindowupgrader.com or submitting a request through it, you agree to them. If you don’t agree, please don’t use the site.

What this service is

We are an estimate-matching service. You tell us about a window or door project, and we connect you with one independent, licensed installer who serves your area.

We are not a contractor. We hold no contractor license, we do not measure, manufacture, install, repair, pull permits, or inspect anything, and we do not employ the people who do. Those services are performed entirely by the independent installer you are matched with.

Your relationship with the installer

This is the part worth reading carefully. When you are matched with an installer:

• Any contract you sign is between you and that installer. We are not a party to it, do not sign it, and have no rights or obligations under it.
• They set their own prices. We do not set, approve, negotiate, or guarantee pricing, and any figures on this site are general market ranges for planning, not quotes.
• They own the warranty. Product and workmanship warranties are issued by the installer and the manufacturer. We provide no warranty on any product or work.
• They are responsible for the work. Quality, timeliness, permits, licensing compliance, insurance, and conduct on your property are theirs.

We verify that an installer holds current state licensing and liability insurance before they receive requests, and we re-check as those renew. That verification is a screening step, not a guarantee of their work, and it does not make us responsible for it. We encourage you to confirm any installer’s license directly with the Florida Department of Business and Professional Regulation before signing anything.

If an installer treats you badly, tell us at hello@thewindowupgrader.com. We can remove them from the network, which we will do. We cannot resolve a dispute under a contract we are not part of.

What you agree to

• The information you submit is accurate, and the phone number and email address are yours or you are authorized to provide them.
• You are 18 or older and are the homeowner, or authorized to act for them.
• You will not submit requests on behalf of someone who has not asked you to, use the site to harvest installer information, or attempt to disrupt the service.

How we contact you

By submitting a request you agree to be contacted about it by phone call and email from a live representative, plus one automated confirmation email. We do not send text messages and we do not use automated dialers or prerecorded voice messages. Consent is not a condition of purchase or service. Details are in our consent and contact policy.

No affiliation

This site is an independent estimate-matching service and is not affiliated with, endorsed by, or operated by any specific home improvement retailer. Estimates are provided by third-party licensed installers. Actual pricing may vary based on project scope and location.

Estimates, pricing, and incentives

Cost ranges, monthly payment figures, tax credits, rebates, grants, and insurance savings mentioned on this site are general information for planning. They are not quotes, not offers, and not advice.

Government and insurance programs are administered by third parties. Their availability, amounts, eligibility rules, and deadlines are set by those parties and change without notice to us. Nothing on this site is tax, legal, or insurance advice, and you should confirm your own eligibility with a qualified professional.

Site content

The content, design, and code of this site belong to us or our licensors. You may use the site for your own purposes as a homeowner, but you may not copy, scrape, or republish it commercially without written permission.

Availability

We try to keep the site running and accurate, but we provide it “as is”. We do not promise it will always be available, error-free, or that an installer will be available in your area. If nobody covers your ZIP code, we will tell you rather than route you to someone unsuitable.

Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of this site or from any work performed by an installer. Our total liability for any claim relating to this service is limited to one hundred dollars ($100), which reflects the reality that this service is free to you and that we are not a party to the installation contract.

Nothing here limits liability that cannot be limited under applicable law, including liability for fraud.

Indemnity

You agree to indemnify us against claims arising from information you submit that you were not authorized to provide, such as another person’s phone number.

Governing law

These terms are governed by the laws of the State of Florida without regard to conflict of laws principles. Any dispute with us will be brought in the state or federal courts located in Duval County, Florida, and you and we consent to that jurisdiction.

Changes

We may update these terms. The date at the top of this page shows when they last changed, and continuing to use the site after a change means you accept the updated terms.
